Zoning Variances
The Board of Adjustment is responsible for reviewing and approving or denying requests for variances from the requirements of the zoning code. The Board is a quasi-judicial board and their decision stays all proceedings. In other words the Board’s decision stands unless overruled by the circuit court.
In reviewing cases the Board must look at issues as outlined in section 405.190 of the Municipal Code of Frontenac. The Board meets on an as needed basis. Applications for the Board of Adjustment are located in the applications file of the Building and Zoning Department. Cases before the Board are heard during a public hearing. Public Hearings require a 15 day public notice, so the request cannot be heard until after the public hearing has been published and the 15 day period passes.
Applications for the Board of Adjustment are submitted to the building department along with 15 copies of the plans for distribution and a $250.00 application fee. There are more fees required for transcription of minutes (which is required) and for the City Attorney’s time that will be assessed after the hearing takes place and the minutes and findings of fact are completed. The decision of the Board is final and may be appealed to the circuit court.
